Terms of Service

1. Agreement
These terms are an agreement between you and Echopoint ("Echopoint", "we", "us"), operated from Québec, Canada. They govern your use of the Echopoint websites, application, API, CLI, and related services (together, the "Service"). By creating an account or using the Service, you accept these terms. If you use the Service for an organization, you confirm you have authority to bind that organization.
Echopoint is a tool for developers and businesses. You must be at least the age of majority in your jurisdiction to use it.
2. Beta service
Echopoint is in beta. It is offered for evaluation and early production-adjacent use, and it is still changing: features may change or be removed, data may be lost, and the Service may be suspended or discontinued, in whole or in part, at any time. We do not promise any service level, uptime, or support during the beta — support is best effort.
3. Your account
Sign-in is provided through Clerk with Google, GitHub, or email. You are responsible for safeguarding your credentials and API keys, and for all activity under your account and organization. Google and GitHub sign-in are governed by those providers' own terms. Tell us promptly at privacy@echopoint.dev if you believe your account has been compromised.
4. Acceptable use
Echopoint executes HTTP requests you define and receives webhook traffic addressed to your endpoints. You agree not to:
- use the Service for anything illegal, or to infringe anyone's rights;
- test, scan, load-test, or attack any API or system you are not authorized to test — flows must only target systems you own or have permission to call;
- send or distribute malware, or use webhook endpoints to receive or relay abusive traffic;
- store or process personal data through the Service without a lawful basis for doing so;
- attempt to break, probe, or circumvent the Service's security or any usage limits;
- resell or provide the Service to third parties as a service of your own.
We may suspend or terminate accounts and remove content that violates this section, with or without notice.
5. Your content
You own the content you create or send through the Service — flows, requests, collections, environment values, specs, and captured webhook payloads. You grant us a limited, non-exclusive license to host, process, and display that content solely to operate and provide the Service. You are responsible for your content and confirm you have the rights needed to use it with the Service.
If you send us feedback or suggestions, we may use them freely and without obligation to you.
6. Our intellectual property
The Service, its software, design, documentation, and branding belong to Echopoint. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service during the beta under these terms. Public source repositories (such as the CLI and runner) are governed by the terms stated in those repositories.
7. Free beta and future pricing
The Service is currently free while in beta, with no payment details collected. Free beta access does not create a right to future free access. If paid plans are introduced, they will be published on the pricing page first, and existing users will get notice before any pricing change takes effect.
8. Privacy
Our Privacy Policy explains what personal information we collect and how we handle it. It is part of how we operate the Service, but your privacy rights exist independently of these terms.
9. Disclaimer of warranties
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties and conditions, express, implied, or statutory — including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain exclusions; those exclusions apply only to the extent permitted where you live.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising from or related to the Service. Our total liability for all claims together is capped at CAD $100. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including liability for bodily or moral injury, or for gross or intentional fault, under the Civil Code of Québec.
11. Indemnification
You will defend and hold us harmless from third-party claims, and associated costs, that arise from your content or from your use of the Service in violation of these terms — including flows that target systems you were not authorized to test.
12. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these terms, or terminate the beta at our discretion. Where practical, we will give you an opportunity to export your flows (flow export is built into the product) before deletion. Sections 5 through 14 survive termination.
13. Changes to these terms
We may update these terms. The date at the top of this page shows the current version. For material changes, we will give notice by email or in the app before the new terms take effect; continued use after the effective date means you accept them.
14. Governing law
These terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable in Québec. Disputes go to the courts of Québec, district of Montréal. If you use the Service as a consumer, this section does not deprive you of protections that the mandatory rules of your place of residence grant you.
